These lawsuits all stand to inflict massive financial damage to the massive chemical and pharmaceutical company. Not only does Bayer have to worry about paying out settlements that can reach the millions for each case, but there is also the matter of their stock value plummeting because of the projected damages they will take. It was even speculated at one point that the German company would face a breakup as a result of the massive wave of litigation they were facing.  In order to deal with this issue, Bayer has proposed paying $8 billion to settle all of the lawsuits filed against them for Roundup related cancer development. The lawyers representing many of the plaintiffs seeking compensation through lawsuits against Bayer have stated that they would prefer the total to be more around $10 million. However, this new strategy on Bayer’s part has brought the negotiations one step closer to resolution and postponed several trials for Roundup lawsuits. Bayer’s previous strategy was much more aggressive with them contesting many lawsuits against them in the hope they could minimize payouts that way. 

Has Monsanto or Roundup Been Sued Before?

Yes. The whole reason Bayer is looking to settle is to save themselves money. After all, the math on 18,000 lawsuits times even 1 Million dollars is 18 Billion dollars. By that math, 8 Billion is a deal.

Dewayne Johnson v. Monsanto

The first lawsuit against Monsanto for their Roundup weedkiller’s cancer contributing properties was filed by a groundskeeper in California named Dewayne Johnson. Mr. Johnson worked for the school district of Benicia in San Francisco starting in 2012 where he regularly utilized Roundup weedkiller in his groundskeeping duties. Dewayne Johnson had long-term exposure to Roundup for years when he sprayed it and it would get on his skin and soak through his clothes despite measures taken to reduce exposure.  After several years Dewayne Johnson would go on to develop terminal non-Hodgkins lymphoma that doctors estimated would kill him by the end of the year. After looking into the possible causes of his critical condition, Dewayne Johnson discovered that there have actually been several studies done on one of Roundup’s more controversial ingredients called glyphosate. These studies came to the conclusion that glyphosate actually has carcinogenic qualities that can increase the chance of developing cancer when exposed. In 2016, Dewayne Johnson began the process of filing a lawsuit against Monsanto which was the company responsible for making Roundup. Through the presentation of persuasive evidence such as the studies showing glyphosate’s ties to cancer development, Dewayne Johnson ended up being awarded $250m in punitive damages and $39.2m for losses. After an appeal by Monsanto, the amount was reduced to $78.5 million.

Edwin Hardeman vs. Monsanto

The followup to the landmark Dewayne case that opened the door for Roundup lawsuits was a case involving a man named Edwin Hardeman. Hardeman had been using Roundup weedkiller on his property for over 20 years and after developing non-Hodgkin’s lymphoma heard about how Monsanto was being sued by Dewayne Johnson. Like Dewayne Johnson, Edwin Hardeman was able to make his case effectively by presenting evidence of glyphosate’s carcinogenic effects and his long history of exposure to Roundup weedkiller. Edwin Hardeman won his case like Dewayne Johnson and was awarded $80 million in damages that would be paid out by Monsanto which was a recent acquisition of Bayer

Future Cases Against Bayer over Roundup Weedkiller

The recent developments in the negotiations between Bayer and the many plaintiffs suing them of cancer allegedly caused by Roundup weedkiller have shown that progress is being made albeit slowly. Future lawsuits against Bayer may likely see something similar to the $8 billion settlement that Bayer has proposed. The number of lawsuits against Bayer is only increasing and attempting to fight every case would not be the most practical solution.
